By downloading, installing, or using Plated Studio (the "App" or "Licensed Application"), you agree to be bound by these Terms of Service and End-User License Agreement ("EULA"). If you do not agree, do not use the App.
This agreement is between you and Plated Studio ("we," "us," or "our"), not with Apple Inc. or any other platform provider. We are solely responsible for the App and its content. These terms are not intended to conflict with Apple's Media Services Terms and Conditions.
PLATED STUDIO provides AI-powered photo transformation services that enhance food photography to professional, studio-quality images. The service includes various styling options, batch processing, selective area editing, and custom style creation.
We grant you a limited, non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The App may also be accessed by other accounts associated with you via Family Sharing or volume purchasing.
To use certain features, you must create an account using either email and password or Apple Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
The App offers subscription plans (Free and Pro) with different feature access and usage limits.
Payment will be charged to your Apple ID account at the confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
Refunds are subject to Apple's refund policies.
You retain all rights to the photos you upload. By using the App, you grant us a limited license to process your images for the purpose of providing our transformation and editing services.
You represent and warrant that you have all necessary rights to the content you upload and that your content does not violate any third-party rights or applicable laws.
In the event of any third-party claim that the App or your use of it infringes that third party's intellectual property rights, we (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
The App may request access to your device's location to help you find your restaurant when setting up your restaurant profile. Location access is optional — you can search for your restaurant without granting location permission. We do not track your location or use it for advertising purposes.
With your permission, we may send you push notifications and local notifications related to your account activity, completed photo transformations, credit usage, and occasional promotional messages about new features. You can manage or disable notifications at any time through your device settings.
You agree not to use the App to:
You also represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You must also comply with all applicable third-party terms of agreement when using the App, including your wireless data service agreement.
The App uses artificial intelligence to transform images. While we strive for high-quality results, we cannot guarantee that all transformations will meet your expectations. AI-generated results may vary.
To provide image transformation and selective editing services, your photos are sent to third-party AI services for processing. By using these features, you acknowledge and consent to your photos being transmitted to and processed by these external services.
These AI services process your photos solely for the purpose of generating transformed images and edits, and do not retain your photos after processing.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
We (not Apple) are responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may also modify these Terms at any time, and such modifications will be effective upon posting.
We are solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
We may terminate or suspend your account at any time for violations of these Terms. You may delete your account at any time through the app settings.
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
